Indonesian Judicial Commission Promotes the Fulfillment of Equal Rights for People with Disability

Jakarta (Indonesian Judicial Commission) – Lack of understanding among law enforcers on how to provide equal access remains an issue in the fulfillment of the rights to fair trial for people with disability. Findings from study by Center for Human Rights Studies of Universitas Islam Indonesia (PUSHAM UII) show how people with disability who undergo trial procedure, which include investigation phase in the police department, prosecution phase in the prosecution office, as well as court examination and ruling, are confronted with many barriers.

In general, the barriers include: (1) law enforcers’ lack of ability in recognizing types of disability and on how to properly treat each type of disability to ensure due process of law, (2) lack of means and facilities causing less optimal investigation, prosecution, and court examination, (3) non-accessible physical infrastructure, such as of buildings, examination room and public facilities, that hinders people with disability to attend phases required in procedures of law, (4) various norms and legal principles causing less optimal fulfillment of the rights of people with disability in trial procedure.

People with disability should be given equal access and provided with opportunities to develop themselves in accordance with their capacity, and that all government policies must be based on measures to eliminate barriers that might hinder people with disability to attain equality.

To support the Indonesian Judicial Commission in upholding honorable and virtuous judicial conduct and dignity, last year the Indonesian Judicial Commission signed an MoU with Sasana Integrasi dan Advokasi Difabel (SIGAB) Yogyakarta. We are now seeing the practical effect of the relationship with the technical assistance of PUSHAM UII to partner in NTB.  And importantly here we are seeing this in an integrated way through the participation of police, prosecutors and judges. 

The Judicial Commission, PUSHAM UII Yogyakarta and with the support from Australia-Indonesia Partnership for Justice (AIPJ) shall conduct training for law enforcers to be held on 23-26 March 2015 in Mataram, Lombok, Nusa Tenggara Barat (NTB).

On the theme of “Enhancing Law Enforcers’ Capacity in The Fulfillment of Rights to Fair Trial for People with Disability in Indonesia”, the training aims to:
-    Introduce law enforcers to the concept of disability
-    Provide law enforcers with an understanding of human rights, particularly the rights of people with disability
-    Provide law enforcers with an understanding of the rights to fair trial for people with disability
-    Provide law enforcers with the skills on the manners and methods to provide accessibility for people with disability in conflict with the law.

Chief Commissioner of the Indonesian Judicial Commission, Mr Suparman Marzuki, will be the Keynote Speaker in the training that will be attended by law enforcers, which include, among others, police investigators, judges, and prosecutors from Nusa Tenggara Barat (NTB) and Nusa Tenggara Timur (NTT).
