Preventing Discrimination Against Women in the Courts

Indonesian women judges have been working with their male colleagues to adopt international standards to overcome bias in the treatment of women in the courts.

A guidance book was launched on 20 January 2018 as part of supporting the Supreme Court Regulation (Perma) Number 3 of 2017 to ensure that every judge exercises sensitivity in dealing with women's cases. This Perma is the result of work started in 2016 by the Supreme Court Working Group on Women and Children with technical assistance and meeting support provided by AIPJ2.

"Why is a special regulation needed for women? The vulnerability of women, both as witnesses, victims, and perpetrators, requires judges who are capable of providing justice and legal certainty, non-discriminating, and respectful of human values and dignity," said Sri Mur Wahyuni, Supreme Court Judges, in her speech as Chairman of the Committee.

The “positive law movement” sees law as a vehicle for social reform that promotes gender equity in order to ensure that women have equal access to justice. 

In his keynote address, the Chief Justice of the Supreme Court Dr. H. Hatta Ali S.H., M.H., reminded judges to be careful not to rebuke or blame women in all stages of the judicial process.

"Judges should consider the impact of power relations between women as victims and male perpetrators. It is also important to adhere to the principle of restorative justice that promotes legal remedies to recover physical, psychological, and economic loss of the victim. The legal process should not just about correcting offenses.”

Following the launch, participants attended a panel discussion session with speakers and women’s rights champions including the Minister of Marine Affairs and Fisheries, Susi Pudjiastuti; Minister of Foreign Affairs, Retno P.Marsudi, and Finance Minister, Sri Mulyani. As a broader step to disseminate the book, the Women and Children Working Group of the Supreme Court and the Indonesian Judicial Monitoring Society (MaPPI) will run a series of public discussions in near future.
